Limitation of Liability

Born Xplorer acts solely as a facilitator between the traveler and various independent third-party service providers, including but not limited to airlines, hotels, embassies, transport operators, and local agents. While we endeavor to provide seamless service, Born Xplorer disclaims any liability for circumstances beyond its control. The traveler acknowledges and agrees to the following limitations of liability:

Visa Services: Born Xplorer may assist travelers with visa documentation and application processes for both outbound and inbound travel. However, the decision to approve, delay, suspend, or reject a visa application lies solely with the respective embassy, consulate, or immigration authority. Born Xplorer, including its employees, affiliates, and agents, shall not be held liable for any consequences financial, emotional, or otherwise arising from a visa refusal, delay, or cancellation, irrespective of the reason.

Non-Refundable Visa Processing Charges: All service charges paid to Born Xplorer for visa consultation or processing are strictly non-refundable, regardless of the outcome of the visa application.

Airline Ticket Issuance During Visa Processing: In cases where a traveler requests or consents to the issuance of airline tickets while their visa application is under process, the traveler assumes full responsibility for any resulting loss due to visa rejection, delay, or suspension. Born Xplorer shall not be liable for any refunds, rebooking costs, or damages incurred.

Third-Party Refunds and Cancellations: In the event of a cancellation or refund claim involving services such as flights, hotels, transportation, or any other third-party services, the terms and conditions of the respective service provider shall govern the process. Born Xplorer shall not be liable for the denial of any refund or compensation by such third parties. However, we may, at our sole discretion, offer reasonable assistance to support the traveler in submitting such claims.

Force Majeure: Born Xplorer shall not be liable for any failure, delay, or disruption in service caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil disturbances, strikes, government restrictions, or other unforeseeable events (“force majeure”). In such cases, no refund or compensation shall be payable.

Exclusive Use of Authorized Ground Handlers: In any destination offering by Born Xplorer or at any designated region, travelers are contractually required to utilize the services of Born Xplorer’s authorized local partners for all ground arrangements. Travelers are strictly prohibited from bypassing or replacing these services with alternative providers. Any attempt to do so shall be deemed a material breach of contract, and Born Xplorer shall bear no responsibility for any resulting inconvenience, cost, or loss.

Accuracy and Authenticity of Traveler Information: It is the sole responsibility of the traveler to ensure that all information provided for bookings, visa applications, or any other services is accurate, complete, and truthful. Born Xplorer shall not be held liable for any issues arising due to inaccurate or false information supplied by the traveler.

Third-Party Provider Liability: Born Xplorer does not own or operate the airlines, hotels, transport providers, or any other third-party service entities involved in the travel arrangements. As such, Born Xplorer is not liable for any act, omission, negligence, misconduct, or failure to perform by any third party, nor for any resulting injury, loss, delay, or irregularity.

Service Availability and Price Changes: All services, products, and itineraries offered on Born Xplorer’s platform are subject to availability and may change without prior notice. Born Xplorer reserves the right to modify, replace, or cancel any part of a travel service if necessary due to operational reasons or third-party constraints, without incurring liability.

Limitation of Financial Liability: Under no circumstances shall Born Xplorer’s aggregate liability to any traveler, whether in contract, tort, or otherwise, exceed the total amount actually paid by the traveler to Born Xplorer for the specific service from which the claim arises.

Travel Insurance Responsibility: Travelers are strongly advised to obtain comprehensive travel insurance that covers cancellations, health emergencies, baggage loss, and personal liability. Born Xplorer disclaims any liability for losses not covered by the traveler’s own insurance policy.

Acts or Omissions of the Traveler: Born Xplorer shall not be held responsible for any damages, injuries, delays, or losses resulting from the traveler’s own actions, negligence, failure to comply with local laws, immigration rules, or health and safety regulations.

Personal Belongings and Baggage: The safety and security of the traveler’s personal belongings remain solely the responsibility of the traveler at all times, whether during travel or at the destination. Born Xplorer shall not be liable for any loss, theft, damage, or misplacement of luggage, valuables, or personal effects, regardless of the circumstances.

Limitation on Indirect and Consequential Damages: Born Xplorer shall not, under any circumstances, be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of opportunity, emotional distress, or loss of enjoyment, even if the possibility of such damages was made known.

Governing Law and Jurisdiction: These Terms & Conditions shall be governed by and construed in accordance with the laws of Pakistan. Any dispute, controversy, or claim arising out of or in connection with the services provided by Born Xplorer shall be subject to the exclusive jurisdiction of the competent courts of Pakistan.
